Rights Issue
ABM Resources NL (ACN 009 127 020) (ASX:ABU) (Company) refers to its ASX announcement on 11 March 2016 regarding an application to the Takeovers Panel by APAC Resources Capital Limited in connection with the Company's proposed rights issue announced on 9 March 2016.
As you will see from the Takeovers Panel's media release, the Takeovers Panel has made a declaration of unacceptable circumstances and has issued an order that the Company may not proceed with the rights issue. The Company will exercise its right to seek a review of the Takeovers Panel's decision by a new composition of the Takeovers Panel. Shareholders will be updated on the outcome of this review in due course.
In accordance with the Takeovers Panel's order, and in the meantime, ABM will not proceed with the rights issue. Once the review has been completed, subject to the findings by the Review Panel, ABM will, if the rights issue can proceed after the review, issue a revised timetable for the rights issue.
